Fair enough response. I hope he stated as much in court, or Capted has it right.

Why does the judge want the Fishers to stay in this? They have no horse in this race. And never did. They knew from day one that they would never link the stones to the Atocha nor any other ship. And yet, the judge put them back in court. Why did the judge use them again? a second chance to do what? Does anyone here honestly think the Fishers are owed anything? On one side, you have people who contradict their recounting of info (JTR). On the other side you have a judge, not another party, just a judge who has gone out of his way to find a scintilla of evidence to keep the stones out of Jay's hand.

The Fishers, with all their diving expertise, would have known the parameters for mounting an offensive to get the stones. First off, witnesses- nothing credible; second, distance- too far to prove otherwise; third, no visual link, no artifact. If they chose to go ahead with it anyway....well we all drew our own conclusions here.

Here is what should have happened and what was stated this past summer, dismissal for lack of evidence. Can anyone tell me why that didn't happen? One reason, and it was stated- the judge wanted to, from early on, change what the trial was originally about. Yes he may be trying to do the right thing, but his job is to rule on what both sides present, not create his courtroom as he sees fit.
