If we listen and place any credence in what George Schilling has stated, CLYW has placed all the large network carriers on notice that they are in possible infringement status of CLYW's ASNAP technology. And the latest is that he has lost all memory of any transactions during his term of CEO..???

but yet,...

Ericsson, BB Mobile Successfully Hand Over IMS Service between 3G and WLAN

Tokyo, Japan, Jul 29, 2005 (JCN Newswire via COMTEX) -- Ericsson and BB Mobile, a Softbank affiliate, jointly completed the world's first test with an IP multimedia subsystem (IMS) between a 3G mobile network and a wireless local area network (WLAN).

The demonstration, using Softbank BB's Yahoo! BB ADSL WLAN network and Ericsson's W-CDMA 3G mobile network, showed that end users can enjoy the IMS service seamlessly by continuously connecting either to the LAN or the 3G.

The two partners plan to incorporate this seamless handover function into the release 8 of the 3GPP.

=====================

so it appears that MOT/CSCO/ERICY most likely had their authoritive legal staff (you know, those that are in the know) read the ASNAP patent and white paper. and it appears that they have let their respective companies know there is no problem.

so we've got three industry giants (MOT/CSCO/ERICY) releasing news regarding seamless roaming and handoffs.

there will be a deployment of their products to the market in early 2006.

the phones will generate millions in sales.

now,...and here's the surprising factor in this scenario,...if George and CLYW want to have any chance of collecting licensing fees and royalty fees that they maintain are due them,....CLYW has to initiate a lawsuit. wow,...what a concept !

then,...heres the real kicker,....it has to be proven in a court of law that MOT/CSCO/ERICY have infringed on the patent.

now,...heres the other kicker,...if it is proven in court that MOT/CSCO/ERICY are not infringing on the patent then what does CLYW have ?,...answer,...a concept that they, CLYW, has never been able to actualize for a marketable product.

here's a thought,... if ASANP does not operate, have real-world functionality that is, and CLYW wants to incorporate seamless roaming into their product, c1250i, and MOT/CSCO/ERICY have a patnet on their technology,....maybe CLYW will have to pay royalty fees for use of that technology to enter the field of seamless roaming/handoffs to incorporate in their 1250i.

ironic isn't it ?
