Perhaps the courts see MNTA's lab technique as useful science but really nothing. Now if MNTA had bio-engineered a bacteria to produce Generic Lovenox, or a machine that created the drug; those might be enforceable patents.

What MNTA invested and patented is closer to a machine than it is to mere “lab technique.” MNTA’s methods include the use of proprietary enzymes and informatics to exclude constituents in the mixture being manufactured that are not present in the same proportion in the product being replicated.
