FTC Judge Issues Rulings, Denies FTC Motion for Default Judgment Wednesday March 5, 12:33 pm ET Rambus will have opportunity to try case on its merits
LOS ALTOS, Calif.--(BUSINESS WIRE)--March 5, 2003--Rambus Inc. (Nasdaq:RMBS - News) today announced that the chief administrative law judge (ALJ) presiding over the proceeding initiated against Rambus by the FTC issued several orders last week. These orders included one denying the FTC complaint counsel's motion for default judgment, and instead creating certain "rebuttable presumptions" stemming from Rambus' 1998 documents retention program. "There have been many preliminary rulings in this case, and we expect many more prior to trial," said John Danforth, Rambus' senior vice president and general counsel. "We have been disappointed by some of the rulings, and pleased by others. Overall, we are pleased that Judge Timony concluded that this case should be decided on its merits and we expect, after all of the facts are presented, that Rambus will overcome any adverse rebuttable presumptions, if any survive to the beginning of trial, and will prevail on the merits."
Rambus has filed a motion for summary judgment based on several issues on which it believes the facts are not in dispute. Rambus' motion for summary judgment, along with last week's rulings, will soon be made available on the FTC's website, http://www.ftc.gov/os/adjpro/d9302/index.htm.
