When the historic High Court Mabo decision was handed down twenty years ago, Gail Mabo was at a hospital breast-feeding her baby. Her son had been born six months earlier, the day before her father was buried. Gail was with her mother-in-law, when she heard the news on ABC Radio.
"I actually cried, because I thought, you know, this is too sad, my Dad's not here to celebrate it, how dare you do this!"
"And then I thought, oh my goodness, Dad, you were right, because when I was fifteen he told me that all of Australia would know his name and sure enough they do."
Gail is the middle daughter of Eddie 'Koiki' Mabo, the political activist from the Torres Strait Islands whose epic campaign for indigenous land rights led to the overturning of the legal doctrine of terra nullius.
His story has been told in MABO which screened on ABC TV.
The film traces Eddie Mabo's life from a young man of 17, through courtship and marriage to his wife Bonita, up to his death from cancer at the age of 55 and the landmark High Court ruling on June 3 1992.
The film is described as being as much a love story as a document of one man's fight to retain what he believed was legally his.
On a visit to Canberra to mark National Reconciliation Week and the 20th anniversary of the Mabo decision, Gail spoke to Louise Maher on 666 Drive about her father's legacy and her role as a cultural adviser on the film.
"I became an assistant to everybody...just to make sure that when they did things about Dad, that it was true, that it wasn't, you know, softened over to make it look good for television. Because...if you're going to tell a story about someone you need to do it warts and all."
Gail explained that her father's campaign and long absences from home were sometimes hard on the family.
"When you're so driven about something the ones that you hurt the most are the ones who are closest to you. And, you know, there were very emotional times in our house, but... there was lots of happy times, and that outweighed the times that weren't nice...but in the end, yeah, this whole telemovie just is Dad".
Gail said her father's presence was felt all the way through from the concept of the film until to the end.
"I believe my Dad's spirit was there because he knew it was something that had to be done and Jimi Bani who plays my Dad did a brilliant job. I'm very happy."
Gail has her own career as a dancer, choreographer and artist. She told Louise that she and her siblings stand tall because of the legacy her father has left.
"Everyone only saw the outcome (of Eddie Mabo's campaign), heard the name. They didn't know anything about who he was or where he came from. So with this telemovie, it actually puts the human factor back into the name. He did it for a reason and he was a man who was culturally proud...of where he came from and ....what he was fighting for. It was his birthright, and he wanted us to have the same birthright and have that shared with his children. He didn't want that taken away."

The recognition and rights of lesbian, gay, bisexual, transgender (LGBT) individuals and couples in Australia have gradually been increasing within the states and territories since the 1970s. Laws regarding sexual activity apply equally to same-sex and heterosexual activity in all Australian states and territories, except Queensland, where there is an unequal age of consent for anal sex. Every state and territory legally recognises both opposite-sex and same-sex relationships as de facto couples and also legally recognises lesbian co-mothers as birth parents of children conceived through in vitro fertilisation or artificial insemination. In the Australian Capital Territory, New South Wales, Queensland, Tasmania and Victoria there are domestic partnership registries, while the other states and territories recognise de facto same-sex couples. Same-sex couples are allowed to jointly adopt children in the Australian Capital Territory, New South Wales and Western Australia, and may adopt their partner's stepchild in Tasmania. In all other states except South Australia, LGBT people are allowed to adopt individually.
At the federal or Commonwealth level, marriage has been explicitly defined as a union between a man and a woman since 2004, when the Marriage Amendment Act was passed. However, since 1 July 2009, same-sex couples receive the same level of recognition as de facto opposite-sex couples in federal legislation including tax, health, superannuation, and aged care.
