I would add that the receiver also must see value or he would not be allowing this journey. He would have taken the best offer from Tmob and hit the road. Or else the daic parties have agreed to fund the litigation, with the understanding they will not be reimbursed if it goes south. The daic parties have likewise made a calculated risk assessment showing they have a better than even chance of winning. You don't spend that kind of money without doing a detailed analysis. I have to assume during mediation over an 8 hour period that some numbers were put out there from Tmob. If you have very little faith in your position going forward, you bail and take the offer. If your case is strong you hold out.
