Technically yes, but the price didn't skyrocket or anything. The Ask at the beginning of trading was a few shares at $.0066, then $.0068. It's traded up and revisited this same area, so I can't imagine the SEC making any kind of stink over it.

It opened at .0061. I saw it hit .0072 within an hour +/-. I would think that an 18% increase might be enough to warrant concern. If just one investor enjoyed that ride, and that one investor was privy to the news prior to the 9:58 am news release, it could result in a problem.

However, others have stated that BBDA (as a pink) falls outside of this regulatory issue. If so, it is a non issue, and some folks enjoyed a nice ride.
