I think it a bit of wishful thinking to consider a reformation of Calypso. There is the larger question of who would run such a company. I don't know anyone currently involved with the company that I would trust enough even if the SEC stuff was not an issue. Either give me cash or freely trading shares in a legitimate company. Sorry, I don't want to be drug along on the next wave of incompetence. I'm not saying Calypso can't be resurrected because stranger things have happened, but it does appear Calypso may have used up it's nine lives. The easiest thing would be to move the asset (patent) into a fully functioning company with freely trading shares. Some type of buyout by a legally formulated company. Dissolve Calypso and let those that want to cash out, sell their shares. Assuming Calypso is successful with the Tmob case, a cash payout from any settlement then a transfer of the patent to a new owner for which current shareholders could get stock in a new company. That way the new owner gives prior shareholders the opportunity to profit in any potential licensing going forward. With a validated patent, the new owner could then file additional infringement cases and continue to derive income from the patent through licensing. This way current calypso owners get a little cash and still have the potential to profit from any licensing deals or infringement cases going forward, if they choose to stay shareholders. The court already said the receiver can exclude whoever he wants from the bidding process. And I don't mean a company formulated by any large shareholders of calypso making a new company. I'm talking about a company already in existence that has been trading on one of the major exchanges, not pink sheets. Seems an easy way to transition the patent and current shareholders without any company having to fork out multi-millions for the patent. At that point any individual shareholder would have received a cash payout and shares, which could be sold in the open market, if they chose. I am looking at a way for current shareholders to profit from the patent going forward and not end up with a small return from the sale of the patent. I would even entertain an offer from Tmob with the right conditions.
