As I said, read the SEC suit against Williams. It's pretty clear his problem was that he was manipulating the stock price.

I also provided the link where the SEC itself says price manipulation is actionable civilly and criminally. There are many examples of pump and dumps being prosecuted.

As for pumping and taking stock not being actionable, maybe, but I wouldn't want to take that chance. Certainly taking undisclosed stock and selling it into a promotion engineered by the recipient, the traditional pump and dump, would like be actionable by the SEC.
