oilsleuth, the quasi-contract as you put it would mean that the Minister's refusal would be of no event as it would be deemed that he accepted the extension application ab initio. In other words, the application for specific performance, if successful (and I am not saying that it will be, just that it is an argument and a very good one at that) would be to put the parties in the same position as if the refusal had never happened.
