I am not certain what you meant by "commitment fee" however the 8-K filing does state that if the Company meets the milestones but elects not to drawdown the second $15MM, they must pay a non-utilization fee of 1.5% of the unused loan amount. Additionally, they had to pay a $300,000 "facility" fee.
