VirnetX to Appeal or Re-file to Clarify a Procedural Discrepancy in its Complaint Against Apple with the ITC

VirnetX™ Holding Corporation (NYSE Amex: VHC), a secure real-time communications and collaboration technology company, announced that on July 18, 2012, the Administrative Law Judge assigned to investigate the complaint, filed by its wholly-owned subsidiary, VirnetX, Inc., with the United States International Trade Commission (ITC) against Apple Inc., has identified a procedural discrepancy with the complaint filed by VirnetX that will impact the scheduling of the investigation. VirnetX disagrees with this finding and intends to appeal and/or re-file the complaint with the ITC as necessary. The Company feels that this does not have any impact on the merits of our complaint with the ITC or the two cases pending in the Eastern District of Texas.
