Sorry for the delay Jim. I was on vacation and took a break from all this.

Actually I could not find the court order that supposedly includes 517. If it was added I believe it will be more helpful to us in getting 37 added as well though.

I don’t really know why CC didn’t want it 517 added. It’s basically identical to 516, possibly just to cause the defense extra work, trying to get them off their game. A lot of gamesmanship like that goes on.

All that matters now is that we get to trial. CC will have its rebuttal to summary judgment entered by 7/25 and it better be intelligent and convincing. This nonsense of a stream substantially free of oil is truly absurd and would be a complete injustice if it stands.
