If SEC had evidence of fraud we don't know what they would have done. It could have been halted or resume trading after investigation is complete. It does not mean select few shareholders take matters/LAW in their own hand let the criminal escape. Also how did that workout? Majortiy of common lost money here. Does not look like a good legal defense.
