You seem to be confusing two different hurdles, the first is FDA approval, the second is TEVA patents. The litigation with TEVA sought to declare TEVA's patents invalid, but MNTA still needs FDA approval to launch their generic. And if FDA approval is obtained, MNTA can launch once the TEVA patents have expired in 2015, even putting aside the outcome of any appeal.
