Alan...I can assure you the SEC is NOT smiling unless it's a wry smile!
The SEC has charged many companies for backdating schemes!
Unfortunately, some incidents took a few years to surface or until the investigation was completed.
However, the SEC's complaint further alleges that because of the undisclosed backdating scheme's they can go after any company at any time!
And separately the DA's Office in the State where the companies are registered continue to undertake remedial measures!
That said...'Execution' may apply!
