So, as we await word from the Court of Appeals regarding the rationale for their vacatur of the injunction, it seems that:

If the Court indicates that its vacatur was solely a function of the adequacy of money damages and not a reflection of the merits of the suit; and

If the Bernstein "nugget" is widely known and understood,

then news of the court's decision should send the share price up considerably because the value of the litigation to MNTA is in the hundreds of million dollars.

Am I missing something?
