If they have already made a plea deal, I don't think they can appeal. Just like the DOJ can't re-charge them as that would be "double jeopardy"...
Sounds suspiciously like the Jerry Eversole case, he had a TON of garbage against him (all of which wasn't even brought forward in the case), yet in the end they made a plea deal where he would "resign" (and still suck his pension from us taxpayers) and admit to one count of lying to a federal officer I think it was. In the end he got a slap on the wrist (probation) for screwing over the public for over a decade!!! If they actually went through with the re-trial and he was found guilty he probably would have been serving 6-10 in federal prison at minimum.
P.S. for the other guy who things I'm I don't know who... I came across the GFCI board from reading stuff over at CTBG. Trying to do a little historical trace on some of these it is just one HUGE mess! It seems like a lot of questionable wheelin and dealin...
