that Newton will be deposed, regardless of whether the judge allows the SEC to exceed the maximum of 9.
As in these type of cases, the plaintiff only gets to depose 9 non-party people/entities/defendants. The SEC is asking the judge for the ability to depose all the companies, up to 15.
If you count the number of companies referenced in the 02/21/12 Answer of Defendants Gendarme Capital Corporation... you can see that only 8 of the original 13 companies are referenced. As such, I'll infer that there's a tacit agreement that RCCH was one of the primarily affected companies from the original complaint, thus necessitating deposition.
Of course, this is simply an inference on my part...
