I don't really know many people on this board, and (although I am a lawyer) I do not disagree with Z's assessment of the legal system.
With that weak introduction, I would really like to get the lawsuit's background documents (e.g., the actual agreements, BME's exercise notice of 02/22/2012, and PCFG's letter of 02/23/2012 rejecting that exercise notice). Earlier, someone posted a link to an SEC notice about entry into the agreements, which is different (I believe) from the agreement(s) themselves. (Also, my post of the complaint was removed, presumably because the pictures of the pages were oversized: I can email the complaint to anyone who wants to PM me an email address.)
Can anyone recommend a contact with PCFG that might be willing to provide these documents? My goal is to explore an argument to shut down the lawsuit, but without the documents I can only guess whether the argument would fly.
Go $PCFG
[CORRECTION: the mods appear to have deleted pages 2 through 7, but not page 1, of the complaint. I guess they thought they were duplicates.]
I am an amateur at this, and it would be unwise to rely on my opinions without your own independent confirmation in consultation with an investment professional.
