Aloof and disinterested??!! Brian is not playing ball because of personality conflict? That doesn't sound like the best way to conduct business. On the other hand maybe Summerhill's terms were commercially unreasonable like perhaps demanding a free KDS. I will try to give Brian the benefit of the doubt that there is more to the story.
