Very few could claim experience with a case like this and I'm not one of them.
Do they have a strong case? Personally I think it's 50 - 50.
Maybe the better question would be: What other driving forces might there be to bring this suit?
I can think of one.
A recent wave of investigations and follow-on litigations brought on by the FDIC and or state regulators and or shareholders, etc. against officers of these failed banking institutions like UWBK are real. The Wamu officer lawsuit comes to mind. There are others since 2008.
Right now the UWBK Officers are pointing the finger of blame at the FDIC by essentially saying 'Regulators are the real screw ups here' not us. So was this suit to go on the attack before the FDIC did??
Sometimes a good offense is better than a good defense.
