From this statement, it doesn't sound like the merger is anywhere close to a done deal if it ever happens at all. It may never happen. I've seen this exact same statement made by companies in hundreds of PR's, following a LOI PR. I think they all read the same book. Disappointment usually follows with no merger ever happening.
"Both companies are in the process of doing their due diligence and are working aggressively to complete this merger".
To say the merger is closing, at this point in time, would be incorrect. Saying it's been confirmed is also incorrect.
