WPI is distributor. If they are at risk, as they almost certainly are, they can say no.

If I may speak for pollyvonwog… I think what he meant in the prior post is that WPI could not have launched independently of Amphastar, while Amphastar could have launched independently of WPI. So, in this technical sense, the launch was Amphastar’s call.
