The SEC only pursues larger cases -- this one is way below its radar. OTC Pink Sheet Bulletin Board is purely a "buyer beware" market -- and investors can sue Herzog and would easily prevail given the magnitude of false and misleading disclosures. Herzog has kept the swindle small enough so he can keep running it ad infinitum.
