I'm thinking the two will get off with a slap on the wrist. Their offering clearly states the way these guys do their business. Take a read through. Their practices may not be ethical, but I don't think the elderly investor will get much back.
Suitability An investment in the Fund is suitable only for persons who have adequate means of providing for their current needs and personal contingencies and have no need for liquidity in their investments. An investment in the Fund should not be made by any person who: (i) cannot afford a total loss of principal, and (ii) has not carefully read or does not understand, the Confidential Private Offering Memorandum (“Memorandum”), including, but not limited to, the discussions of risks, conflicts of interests and income tax consequences of partnership investment and the limitations on the ability to withdraw assets. An investment in the Fund through the purchase of Limited Partnership Interests is suitable only for sophisticated investors for whom an investment in the Fund does not constitute a complete investment program and who fully understand and are able to assume the risks involved in the Fund's investment program. The Fund's investment practices, by their nature, involve a substantial degree of risk. Investors will not have an opportunity to select or evaluate any of the Fund’s investments, or to review the Fund’s securities positions at any given time.
