Actually in this it is and was, just like the Safe Harbor states it may or may not happen, no document currently exists to support the conclusion that an agreement was ever finalized thus the entire PR was in fact a forward looking statement. It was all future speak, so in this case it clearly is in a fact nothing more than a forward looking statement.
