Except that it didn't say that specifically from what I recall, so I don't see how it's clear, especially in light of the fact that the DS referred to using the $17 billion NOLs repeatedly.

I think we should be told explicitly which NOL is being targeted. If we know specifically which NOL we intend to use, then we can argue for APR in a much stronger position if we know it's the $6 billion WMB stock abandonment NOL because we don't need common equity to use that.

I do, however, agree that it is more likely that they were referring to the WMB abandonment NOL, but still, I wish it was definitive. That's why I hate legal documents.
