Hap, i am not advocating any employer go do that(not withholding) unless they have real big cahones .,,, no one wants to endure those situations you posted earlier. I am just posting this to show all the rules that the beauracracy of the IRS has imposed, ie. having employers do their work for them by collecting taxes from the workers and general labor base off the top, so to speak, and then somebody actually comes along and says "wait a minute here, where does it legally or constitutionally say I as an employer have to do that for you the IRS, and do it uncompensated, ,,so btw, lets let the courts decide. This is pretty much what this Banister guy has done.
I do not agree with the IRS's ability to confiscate my or your private labor before its actually been calculated what part of it is 'net' taxable labor income. Add into that, the entire mess of the IRS code and politicians meddling and control of incentives like deductions etc, and you see what the code has turned into.
also you are right, there are some cpas in the past that are not participating in portions of my income any longer, allthough I do have a CPA who has been my partner in various deals since 1994,
Lets find ways to make money and mutually benefit as much as possible. r.
