It's not spelled out in the patent, but presumably one skilled in the art would figure out which variant of HPLC would need to be used, i.e. some variant of SAX, in order to arrive at the signature for Peak 9 (or any other) by the HPLC route. I was taken aback by Dr. Azadi's assertion that you can't get there that way (I haven't seen her actual declaration). Maybe she meant by itself. But with the plot of the CE in Fig 1, I would think that would be enough.
So I agree, the patent looks to be enabled,
even without the 1,6 anhydro labeled.
There is still too much under seal to know the outcome, but my odds of success on the PI have gone up, to something like 65%, FWIW.
