Keith, They have to prove, among other things, that INTEL is a monopoly, so they indeed have to bring all this stuff up to describe why they are a monopoly, and how they dominate the market.

I don't buy that excuse. It's not too hard to demonstrate that in any court, as Jim Barksdale demonstrated in Congress in his testimony against Bill Gates. ( http://marketplace.publicradio.org/shows/1998/03/03_mpp.html )

It's been commented many times that AMD's legal maneuvers is more of a publicity stunt than anything else. Most of their allegations against Intel are hyped up nonsense, even in the context you provide (proving that Intel is a monopoly). Hence when faced with AMD's motives, their unfulfilled goals, and their questionable credibility, one has to ask, "Is AMD really locked out of the market, or are they just pretending to be?"

Lots of other aspects of this case we can argue over, but one thing is clear: Unlike what you said before, this is CLEARLY a matter of opinion, both that of the court and that of the public.
