Is all of this just semantics though?

I'm sure you're right that there are lots of parts that they could be "working on" without doing much of anything, but that kind of public statement is really -- without some kind of clarification, and soon -- the kind of thing that should make their legal department cringe...unless they are fine with it.

I'd like to think that legal is fine with it.

It's the kind of statement that is toward the outside edge of "puffery" or "management optimism," but Berger isn't one of these loose-cannon CEOs who is constantly getting reined in by his handlers.

I'd like to think he's savvy enough to know better than to say something like that without something substantive to back it up -- you're right, he doesn't need a lot, but I hope he wouldn't throw that kind of talk around lightly.
