I agree with you - that verbiage comes across as Not Too Compelling. "May" be shut out of GPOs? - what if the FDA approval had been weeks later - too late to prepare bids on time - they would have been shut out "for years?" And the fact that they'd like to unload a couple of pallets of first-(test?)-batch soon-to-be-expired lots? I can imagine the buyers clamoring for those. It really drives home the impression that this dog's breakfast of legalese was the result of being caught unprepared for that approval.
