No, the motion to modify or dismiss the TRO is independent of the motion to dismiss or transfer for lack of jurisdiction. I think the hearing tomorrow is just on the motion to modify the TRO. Seems to me that Amphastar at least made enough of an argument to justify a hearing, so I'm not sure you should be drawing inferences from the fact a hearing was scheduled.
