Discovery affects the terms of a settlement, and I expect that to occur in this instance. However, the impetus to consider a settlement in the first place comes from the enormity of the stakes.

Hmmm, I think that was agreement that most settlements are, in fact, sometime much later in the process than in the early part of discovery.
