I don't know if someone has dug up why International Medical Systems was part of the lawsuit and what significance that may have (sorry I've been skimming some posts lately)?
I am not a big believer in fighting with the FDA (despite Amphastar's success) but I was a tad suprised the FDA was not named as a defendant since they likely were influenced by Momenta's technology (based on the 5 criteria) though I am not familiar enough with the patents to know how much of an overlap there was.
