Why should my heirs be taxed again when I pass it on to them?

You may have to talk to you state legislature. Most states recoup any reductions in Federal estate tax as a tax preference item. I don't think reduction in estate taxes currently on the table will reduce total taxes paid upon death.

I do gift the $10K every year to my daughter's trust fund. I would be hard pressed to avoid estate tax besides life insurance proceeeds.
