The motion is in the CRIMINAL MATTER NOT THE CIVIL MATTER WHICH IS ASSIGNED DOCKET NUMBER 10-CR-600. The court's review of that docket shows that counsel did not make the motion under the criminal docket at all. The court will rule on the motion when it is properly filed. Counsel are admonished not to waste the court's scarce time and resources or to unnecessarily clutter up case dockets by improperly filing motions.
