Plas2Fuel is aware that Hazardous Waste
Regulations for making waste determinations may apply to the process waters, the residual from
treating the process waters, and any other residual generated from processing the flaked plastic.
Based on DEQ’s understanding described above, a Solid Waste Disposal Permit (SWDP) is not
required at this time for the Plas2Fuel operations, as Plas2Fuel is not accepting solid waste but
rather purchasing prepared plastic flakes. However, DEQ will reevaluate whether a SWDP is
required should Plas2Fuel alter its operations or decide to accept, store, and process mixed waste
plastics (solid waste). DEQ may also revisit whether a permit is required at any time based on Plas2Fuel Permit Determination
new information, new or modified regulations or policies or if DEQ determines that the nature,
amount or location of materials is such that they constitute a potential threat of adverse impact to
waters of the state or public health. Plas2Fuel should also advise potential clients that a SWDP
may be required if the proposed new facility manages solid waste.
