There was a deadline, and IMO, the Indenture Trustee chose to file only under the guarantee for the senior debt, thus, throwing the CT's under the bus. But, eventually if challenged again, I will have my moment before Judge Peck and bring this up or reach a settlement with debtors council. I do not think this will pass the smell test in court.
