It is clear that they traded whenever their 'confidentiality' agreements expired. They said so in the last hearing. Suggest you read the transcript at the same time as listening to the audio.

However, the standard is not whether you traded during negotiations.

The standard is did you trade when having Non-Public Material Information -- regardless on whether negotiations are or were going on.
