I meant the appeal needs to be based on inequitable conduct. how can appeal be based on something else(infringement, etc), when the judgement of invalidating patents was based on inequitable conduct

Also, doesn't inequitable conduct overrides everything ? Inequitable conduct in simple language implies the patent would not have been possible but for the conduct. IMO it is redundant to allege infringement or something else, when inequitable conduct is proven
