This does not stop people from making the old 8-10 lb widgets because they overlap. Even if an individual widget was under 8.5 it would not infringe.
It would only prevent those trying to make widgets specifically in the lower range.



In this case, IMHO , FDA would not approve generic copaxone if the molecular weight is not within range of 5kDA-9KDA.
And we know TEVA has "CoM" patent(incremental innovation over the 1972 CoM patent) that claims "lower molecular weight 5K-9KDA is less toxic".
Hence, any generic copaxone that falls in "5K-9KDA"(FDA IMHO will not approve a generic if it does NOT conform to that range, unless of-course it is proven that the claim was falsehood) would infringe on TEVA's patent. Let's agree to disagree. Thank you for your inputs. We are all as investors trying to dig information the best we can.
