Klausner spent over an hour on the issue with "market price".
It should be obvious that the current market price of MMPIQ has a price ceiling created by the Charlestown Plan taking 55 percent of the stock away from shareholders at $.35. In my view, Klausner did an excellent job of creating an analogy in which an estate has $100 million in cash after paying creditors and a plan proponent wants to buy 55 percent of the business for $23 million. The argument seemed to alter the thinking of Judge Kaufman.
