Personal Injury Lawyer Charged With Tax Evasion

A personal injury attorney who was arrested twice last year for allegedly stealing client funds is now facing tax charges. On Wednesday, Manhattan District Attorney Cyrus R. Vance Jr. announced that Marc A. Bernstein, 55, formerly a name partner of Bernstein & Bernstein and the son of former Brooklyn Supreme Court Justice Aaron D. Bernstein, had been accused of failing to file tax returns from 2003 through 2007 and understating his gross income in a 2008 return.

Charged with three counts of repeated failure to file personal income and earnings taxes, second-degree criminal tax fraud, and offering a false instrument for filing in the first degree, prosecutors accused Bernstein of evading roughly $220,500 in personal income taxes. In July, Bernstein was arrested for allegedly stealing more than $1.5 million from five clients. A month earlier, Bernstein spent two days in jail before his father bailed him out by tendering his pension as collateral.

All told, prosecutors have accused Bernstein, who was suspended from practicing law last April, with stealing $2.2 million in settlement monies from 16 personal injury and medical malpractice clients.
