fuagf -- never have taken the time to get much into oil&gas/mineral rights in Texas -- from your article and my links re the Barnett Shale, obviously the state can have a stake/role, and local governments can be able to collect from wells on their lands -- and clearly private landowners can also collect when they own the relevant rights under their their lands, per one very brief summary at http://www.almc.biz/gas-mineral-oil-rights.aspx and one outline (which may or may not be substantially up-to-date or even particularly well put-together) at http://www.beardenlawfirm.com/Texas%20Oil%20and%20Gas.pdf -- one reason I've never much gotten into it is because it's a matter that has to be determined on a property-by-property basis, a matter of title history and such, rather than something that can be reduced to an answer applicable generally to all properties in the state
