The incident you are referring to was a typical omnibus hearing; not one where litigation involving witnesses and further evidence was going to occur, such as a confirmation hearing. In a confirmation hearing, evidence must be presented prior to the hearing. See WithCatz's comments from earlier today (or maybe it was late last night).
