Because below ground pests migrate more slowly (I assume) than above ground pests, so "stacking" above plus below ground pest control automatically ups the amount of area which you have to set aside and not use modified strains.

The refuge requirement for single traits targeting ‘above ground’ insects is 50 percent; the requirement for traits that target ‘below ground’ insects is 20 percent. When the traits are stacked, the refuge requirement defaults to 50 percent.
