"Complaint for Patent Infringement
On 12 January 2011 (Hong Kong time), Ruyan Investment (Holdings) Limited (the “Plaintiff”), a
wholly-owned subsidiary of the Company, has initiated a civil action for infringement of its patent,
United States Patent No. 7,832,410 (the “410 Patent”) against (i) Smoking Everywhere Inc., a
corporation incorporated in Florida and (ii) Instead, LLC and BLEC, LLC, which are incorporated
in Nevada with limited liability (collectively, the “Defendants”) by filing a complaint for patent
infringement against the Defendants (the “Complaint”) in the United States District Court of the Central
District of California (the “US Court”). The Plaintiff is the owner, by proper assignment, of the 410
Patent which is the first United States utility patent issued in the name of Mr. Hon Lik, who is one of
the executive directors of the Company and is recognized as the inventor of the electronic cigarette.
The Company is confident that it will prevail in this litigation and that its patent portfolio will provide
broad patent coverage over the electronic cigarettes as more patents are granted from our core patent
applications. "

However, the Ruyan announcement does only mention, "Smoking Everywhere Inc.", not "Smoking Anywhere" which is a subsidiary of VPCO but after doing some digging I found that VPCO owns many subsidiaries and has many brands. There are many on the internet blogs who think that the florida based Smoking Everywhere is another brand like Smoking Anywhere run by the same group just with different incorporations. Though it could be that people are just simply getting the names confused, so perhaps VPCO is NOT getting sued just yet by DGTLF but I will keep searching the internet for more info.
Newmedman - didn't you previously find info in the lawsuit literature that somehow Vapor Corp had been doing business as 'Smoking Everywhere' as well as 'Smoking Anywhere' and that DGTLF was in fact suing both brands??
Even so, none of this is actual proof, I was just making the assumption that with the warning that VPCO gave along with the suggestive connections between the brands that VPCO was getting sued by DGTLF, but from now on I will not state this, it is speculation.
cheers
