FURTHER EXPECTATIONS
If all goes according to normal procedural schedules, both sides should have the opportunity to depose the other sides' witnesses. And with 10 witnesses listed and only 2 weeks left, things are about to heat up bigtime. Especially because, barring any reason to seal the records, those depositions will be of public record and not only fully available to Frizzell but ultimately to the viewing public. So, forget the hearing. EVERYTHING IS PUBLIC RECORD AS OF THE FIRST DEPOSITION. Right now, cmkx has the right to depose witnesses. And presumably the SEC will want to depose cmkx's witnesses. And both will get to ask their own witnesses questions on the record. What does this mean? CMKX can get some pretty interesting information ON THE RECORD before the hearing. I think we'll have some more interesting tidbits soon if the depositions start getting scheduled. The bigger question is how badly the SEC wants to go forward with depositions. We should start knowing a LOT more about what is happening very soon. Naked shorting is on the exhibit list. Should be fascinating to see how this works its way into the case. There are many angles imo. Hopefully Frizzell will keep us updated on when depositions are being scheduled. It's crunchtime. Barring another hearing delay, it's game on! Nighty night.
